Terms of Service

These Terms of Service ("Terms") govern your use of Inpaintly (the "Service"), operated by Ascend Global Data ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Inpaintly is an AI photo editing service that lets you upload a photo, mark a region of that photo, and apply a text prompt (or pre-built theme prompt) to regenerate that region using third-party AI models. The Service is provided on an "as is" basis.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service you represent that you meet this requirement and that all information you provide is accurate.

3. Accounts

You are responsible for the security of your account and for all activity that happens under it. You agree to notify us immediately at hello@inpaintly.app if you suspect unauthorised access.

4. Credits and Payments

The Service is sold on a credit-pack basis. One credit is consumed per successful generation. Credits do not expire. Payments are processed by our merchant of record, LemonSqueezy, and are subject to their terms. Prices are listed in USD and may include applicable taxes.

We reserve the right to change prices at any time. Changes will not affect credits already purchased.

5. Ownership of Content

Your inputs: You retain all rights to the photos you upload. You grant us a limited licence to process them for the sole purpose of generating your requested output.

Your outputs: Subject to your compliance with these Terms, you own the images the Service generates for you and may use them for personal or commercial purposes.

Model training: We do not use your uploads, masks or generated images to train any AI model.

6. Prohibited Content

You may not upload, generate or share content that:

• Depicts any person under 18 years old in a sexual, suggestive or nude context;
• Depicts a real identifiable person without their consent, including deepfakes, impersonations or non-consensual intimate imagery;
• Is intended to harass, defame, threaten, dox or intimidate any person;
• Infringes intellectual-property rights, trademarks or rights of publicity;
• Depicts extreme violence, gore, terrorism or promotes self-harm;
• Is illegal where you live or where the output will be distributed.

We reserve the right to block, remove or permanently suspend accounts that violate this section, with or without notice, and without refund.

7. AI-Generated Output Disclaimer

Generative AI is imperfect. Outputs may contain artefacts, anatomical errors, unexpected elements, or may not match the prompt. We do not guarantee any specific result. A generation that fails due to a server-side error will be refunded in credits automatically; a generation that succeeds but does not match your taste does not qualify for a credit refund.

8. Third-Party Services

The Service uses third-party providers including Supabase (auth, database, storage), Replicate (AI model hosting) and LemonSqueezy (payments). Your use of the Service is also subject to their respective terms. We are not responsible for outages or changes in those services.

9. Termination

You may delete your account at any time by emailing hello@inpaintly.app. We may suspend or terminate your access if you breach these Terms. Unused credits of a terminated account due to our action (not a Terms breach) will be refunded pro rata.

10. Disclaimers and Liability

To the maximum extent permitted by law, the Service is provided without warranty of any kind. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

11. Indemnity

You agree to indemnify and hold Ascend Global Data harmless from any claim arising out of content you upload or generate in violation of these Terms.

12. Governing Law

These Terms are governed by the laws of Sri Lanka. Disputes will be resolved in the courts of Colombo, Sri Lanka, unless your local consumer-protection law grants you a non-waivable alternative.

13. Changes

We may update these Terms from time to time. Material changes will be announced on this page with a new "last updated" date. Continued use of the Service after a change means you accept the updated Terms.
